By utilizing the services provided by Epsilon Three Networks in any form (including this website), you agree to be bound by the terms of this policy. If you do not agree to the terms of this policy, you may not utilize any services provided by Epsilon Three Networks.
Epsilon Three Networks is operated from the city of Huntsville, Alabama. We make no claims that services offered by Epsilon Three Networks and/or its users are legal and valid in any other municipality. By continuing to utilize the services we provide, you do so at your own risk and assume full responsibility for your compliance with the local laws in your municipality. You agree tha the laws of Huntsville, state of Alabama shall govern any transactions between you and Epsilon Three Networks or that utilize our systems. You further agree that any legal proceedings shall take place in Madison County, Alabama.
While we will make every reasonable effort to insure the integrity of data stored on our systems, Epsilon Three Networks is not responsible for making backups of data stored on our systems. Each user is responsible for maintaining their own backups of any and all data they deem essential.
EPSILON THREE NETWORKS ASSUMES NO LIABILITY FOR THE ACTIONS OF ITS USERS. By continuing to access the services we provide, you agree that Epsilon Three Networks shall not be held liable in any way, shape or form for any damages arising from your use of our systems or anything provided by any of our users via our systems. You further agree that, in the event legal action against Epsilon Three Networks results in a judgement against you, you will pay in full all costs incurred by Epsilon Three Networks for the legal action in question, including attorney fees, court costs, collection and settlement costs, in addition to and judgements awarded by the court to Epsilon Three Networks. In the event that Epsilon Three Networks is found liable for damages arising from your use of our systems, you agree that our liability for damages will be limited to $0.00. You further agree that, in the event that Epsilon Three Networks is found liable for damages arising from the actions of any of our users, that user agrees to assume full responsibility for the settlement of judgement.
Epsilon Three Networks reserves the right to terminate services to any user without any notice and at any time.
Epsilon Three Networks reserves the right to modify, change or terminate this agreement at any time and for any reason. While we will make every reasonable effort to communicate changes to our users, you agree that we are under no obligation to do so.
If any provision of this agreement is found to be unlawful, unenforcable or otherwise voided, you agree that the provision in question shall be held to be a separate agreement from this agreement, and that the remainder of this agreement shall remain in effect.
Epsilon Three Networks reserves the right to audit and monitor any and all communications originating at, passing through, or terminating at our systems, for any reason at any time.
Unsolicited commercial e-mail - “spam” - is not allowed to be transmitted to Epsilon Three Networks’ users. Individuals or entities violating this restriction are subject to prosecution under applicable civil and criminal statutes. The use of Epsilon Three Networks’ systems to engage in the distribution of unsolicited commercial e-mail or other unsolicited bulk postings or mailings by any of our users is prohibited.
The use of any systems controlled by Epsilon Three Networks by unauthorized users, for any reason, is prohibited, and will be considered theft of services and prosecuted to the fullest extent of the law. Any attempts to gain access to Epsilon Three Networks systems or equipment, by any users unauthorized to do so, will be reported to the Federal Bureau of Investigation for criminal prosecution.
The user of Epsilon Three Networks’ systems to engage in any illegal activity as defined by the laws of the city of Huntsville, state of Alabama, is prohibited. Epsilon Three Networks will coordinate fully with any duly-empowered law enforcement agency in the investigation of crimes committed using our systems within the proper legal framework of our locale.
